Welcome to AfriLux Hospitality. By accessing or using our website, services, and platform (collectively, the "Services"), you agree to comply with and be bound by the following Terms and Conditions. Please read these terms carefully before using our Services.

If you do not agree with any part of these terms, you must not use our Services. By using our Services, you accept these terms in full.

1. Definitions

• "AfriLux Hospitality" refers to AfriLux Hospitality and its affiliates.
• "Services" refers to our job board, executive search, HR consulting, and operational management services.
• "User" refers to any individual or entity using our Services.
• "Employer" refers to any User posting job opportunities or searching for talent.
• "Candidate" refers to any User applying for jobs or submitting a profile.

2. Acceptance of Terms

By using our Services, you confirm that you have read, understood, and agree to these Terms and Conditions. If you are using our Services on behalf of a company or organisation, you represent that you have the authority to bind that entity to these terms.

3. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these terms.

4. User Accounts

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information and to update it as necessary. You are solely responsible for maintaining the security of your account and password.

5. Job Postings & Applications

5.1 For Employers

• You are responsible for the accuracy and legality of all job postings
• You agree not to post discriminatory, misleading, or fraudulent job advertisements
• You agree to respond to applications in a timely and professional manner
• You agree to pay any applicable fees for job postings or services rendered

5.2 For Candidates

• You are responsible for the accuracy and truthfulness of all information you provide
• You agree not to submit fraudulent or misleading applications
• You acknowledge that we do not guarantee employment or specific outcomes
• You agree to respect the confidentiality of any employer information you receive

6. Payment Terms

• Job Postings: Fees are due upon submission and are non-refundable unless otherwise stated
• Executive Search: A 50% deposit is required before the search begins, with the remaining 50% due upon successful placement
• Operational Management: Fees are invoiced monthly and due within 15 days
• Late Payments: We reserve the right to charge interest on overdue payments at 1.5% per month

7. Refund Policy

• Job Postings: Non-refundable once posted
• Executive Search: 90-day guarantee – if the placement doesn't work out, we will replace the candidate at no additional cost
• Operational Management: Pro-rata refunds for unused months with 30 days' notice

8. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of AfriLux Hospitality or its licensors and is protected by copyright, trademark, and other intellectual property laws.

• You may not reproduce, distribute, or create derivative works from our content without our express written consent
• You retain ownership of content you submit (e.g., job postings, CVs) but grant us a license to use it to provide our Services

9. Limitation of Liability

To the maximum extent permitted by law, AfriLux Hospitality shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

• Your use of our Services
• Any inaccuracies in job postings or candidate profiles
• Any employment decisions or outcomes
• Any third-party conduct or content

Our total liability for any claim arising from these terms shall not exceed the total amount paid by you to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless AfriLux Hospitality and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses arising from:

• Your use of our Services
• Your violation of these terms
• Your violation of any applicable laws or regulations
• Your infringement of any third-party rights

11. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, for any reason, including but not limited to:

• Violation of these terms
• Fraudulent or illegal activity
• Non-payment of fees
• Upon request, we will delete your account and personal data (subject to legal retention requirements)

12. Third-Party Links

Our website may contain links to third-party websites. We are not responsible for the content, privacy practices, or availability of these external sites. Any access to third-party sites is at your own risk.

13. Governing Law & Dispute Resolution

• Governing Law: These terms are governed by the laws of the Federal Republic of Nigeria
• Jurisdiction: Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Nigeria
• Alternative Dispute Resolution: We encourage resolution through mediation or arbitration before litigation

14. Changes to These Terms

We may update these Terms and Conditions from time to time. Any changes will be posted on this page with an updated "Last Updated" date. We encourage you to review these terms periodically.

15. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These terms constitute the entire agreement between you and AfriLux Hospitality regarding your use of our Services and supersede all prior agreements and understandings.
