Welcome to HospitalityRecruit. By accessing or using our website and services (collectively, the "Services"), you agree to comply with and be bound by the following Terms and Conditions. Please read these terms carefully before using our Services.

If you do not agree with any part of these terms, you must not use our Services. By using our Services, you accept these terms in full.

1. Definitions

• "HospitalityRecruit" refers to HospitalityRecruit and its affiliates.
• "Services" refers to our executive search, HR consulting, and operational management services.
• "User" refers to any individual or entity using our Services.
• "Employer" refers to any User engaging us for recruitment or consulting services.
• "Candidate" refers to any individual whose profile we submit to an Employer with their consent.

2. Acceptance of Terms

By using our Services, you confirm that you have read, understood, and agree to these Terms and Conditions. If you are using our Services on behalf of a company or organisation, you represent that you have the authority to bind that entity to these terms.

3. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these terms.

4. Our Services

HospitalityRecruit provides the following services to hotels, restaurants, resorts, event centres, and hospitality businesses across Nigeria:

• Executive Search: Confidential recruitment of senior hospitality leaders including General Managers, Directors, and Heads of Department
• Hotel Leadership Placement: Recruitment for key departmental roles in hospitality operations
• Operational Management: Full operational support for hotels and hospitality properties
• HR Consulting: Advisory services for hospitality businesses including recruitment process design and HR policy development

5. Engagements and Agreements

5.1 For Employers

• All engagements are confirmed in writing before work begins
• Scope, timelines, and fees are agreed in advance and documented in a Service Agreement
• You agree to provide accurate information about the role, company, and requirements
• You agree to respond to shortlists and candidate submissions in a timely, professional manner

5.2 For Candidates

• You are responsible for the accuracy and truthfulness of all information you provide
• Your profile is only shared with employers with your explicit consent
• You acknowledge that we do not guarantee employment or specific outcomes
• You agree to respect the confidentiality of any employer information shared with you

6. Fees and Payment

• All fees are agreed in writing before work begins
• Executive Search & Placement: Fees are invoiced on the agreed schedule (typically a deposit to begin and the balance on successful placement)
• Operational Management: Fees are invoiced monthly as agreed
• HR Consulting: Fees are invoiced per engagement or as agreed
• Payment terms are specified in each Service Agreement

7. Placement Guarantee

Where a placement guarantee is agreed in writing, if a placed candidate leaves within the guaranteed period, we will run a replacement search at no additional fee. Full terms of any guarantee are specified in the relevant Service Agreement.

8. Confidentiality

All information shared during an engagement — including company details, candidate profiles, and commercial terms — is treated as confidential. We will not disclose this information to third parties except as required to deliver our Services or by law.

9. Intellectual Property

All content on our website, including text, graphics, logos, and design, is the property of HospitalityRecruit and is protected by copyright, trademark, and other intellectual property laws.

• You may not reproduce, distribute, or create derivative works from our content without our written consent
• You retain ownership of content you submit (CVs, job descriptions) but grant us a limited license to use it to deliver our Services

10. Limitation of Liability

To the maximum extent permitted by law, HospitalityRecruit shall not be liable for any indirect, incidental, consequential, or punitive damages arising from:

• Any inaccuracies in information provided by Employers or Candidates
• Any employment decisions or outcomes
• Any third-party conduct or content

Our total liability for any claim arising from these terms shall not exceed the total amount paid by you to us in the 6 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless HospitalityRecruit and its affiliates from and against claims, liabilities, damages, losses, and expenses arising from:

• Your breach of these terms
• Your violation of any applicable laws or regulations
• Any false or misleading information you provide to us

12. Termination

Either party may terminate an engagement in writing as specified in the relevant Service Agreement. We reserve the right to decline or discontinue any engagement at our discretion.

13. Third-Party Links

Our website may contain links to third-party websites (such as WhatsApp). We are not responsible for the content, privacy practices, or availability of these external sites. Any access is at your own risk.

14. Governing Law & Dispute Resolution

• Governing Law: These terms are governed by the laws of the Federal Republic of Nigeria
• Jurisdiction: Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Nigeria
• Alternative Dispute Resolution: We encourage resolution through good-faith discussion and mediation before litigation

15. Changes to These Terms

We may update these Terms and Conditions from time to time. Changes will be posted on this page with an updated "Last Updated" date. We encourage you to review these terms periodically.

16. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These terms, together with any applicable Service Agreement, constitute the entire agreement between you and HospitalityRecruit regarding your use of our Services and supersede all prior agreements and understandings.
